General Terms and Conditions

Identity

Law firm Everest is a civil partnership of lawyers under Belgian law. Its sports department operates under the brand name Everest Sports Law. The firm has offices in Brussels (Louizalaan 283/19, 1050 Brussel), Ghent (Bollebergen 2A bus 20, 9052 Gent) and Antwerp (Bosmanslei 29, 2018 Antwerpen).

Scope of application

These general terms and conditions apply to all instructions entrusted to Everest, unless expressly agreed otherwise. By instructing the firm, the client accepts these general terms and conditions.

Fees and costs

Fees are calculated on the basis of:

  • The hourly rate of the lawyer(s) involved;
  • The complexity and urgency of the file;
  • The importance of the case and the result obtained;
  • The experience and specialisation of the lawyers involved.

At the start of the instruction, an estimate of the expected fees is made. Third-party costs (court registry fees, translations, expert costs, etc.) are charged to the client.

Payment

Invoices are payable within 30 days of the invoice date, unless stated otherwise. In the event of late payment, default interest equal to the statutory interest rate shall be due by operation of law and without prior notice of default, increased by a fixed compensation of 10% of the outstanding amount.

Confidentiality and professional secrecy

All lawyers of the firm are bound by professional secrecy. All information disclosed by the client is treated as strictly confidential in accordance with the deontological obligations of the legal profession.

Liability

Everest’s liability for damage resulting from a professional error is limited to the amount covered by the firm’s professional liability insurance. Everest shall not be liable for indirect damage or consequential loss.

Complaints procedure

Complaints about the services provided are handled internally. If an amicable solution is not possible, the client may contact the Order of Flemish Bars (Orde van Vlaamse Balies, OVB). For more information: www.advocaat.be.

Applicable law and competent court

Belgian law applies to the legal relationship between Everest and the client. Any disputes shall be settled by the courts of the judicial district of Ghent, unless the law imposes mandatory rules of jurisdiction.

Personal data

Everest processes the personal data of clients and prospective clients solely within the framework of the performance of the instruction and the legal profession’s statutory obligations. Data subjects have the right to access, rectify and, in the cases provided for by the GDPR, erase their data. Requests may be addressed to sport@everest-law.be.

Amendments

Everest reserves the right to amend these general terms and conditions. The most recent version is always available on this website.
