1. Juridische actie tegen de FIFA Football Agent Regulations

 

De FIFA Football Agent Regulations, goedgekeurd op 16 december 2022, zijn gedeeltelijk in werking getreden op 9 januari 2023. De nieuwe regelgeving is controversieel en perkt de vrijheid van het beroep van voetbalagent sterk in. Er werden reeds verschillende initiatieven genomen om deze regels aan te vechten voor nationale rechtbanken. Voornamelijk binnen Europa wordt kritiek geleverd op de rechtmatigheid en proportionaliteit van de regelgeving.

 

Hoewel vele agenten reeds op 19 april 2023 het nieuwe FIFA examen aflegden, blijkt nu dat de definitieve inwerkingtreding van de nieuwe regelgeving op 1 oktober 2023 geen evidentie is. De arrondissementsrechtbank van Dortmund te Duitsland heeft namelijk de toepassing van de FFAR op het Duitse grondgebied geschorst. Dit betekent dat, zolang de schorsing loopt, de nieuwe regels – inclusief de cap op het commissieloon – niet van toepassing zijn binnen Duitsland. Een voetbalagent actief in Duitsland, zal niet verplicht zijn het commissieloon te beperken tot 3 of 5% vanaf 1 oktober 2023.

 

Het precedent in Duitsland kan aangewend worden en kan rechters van andere landen overtuigen om eenzelfde beslissing te nemen. Dit zou dan weer tot gevolg kunnen hebben dat de inwerkingtreding van de nieuwe regelgeving, zoals we ze nu kennen, uitgesteld of vermeden zou kunnen worden.

 

Dergelijke schorsing vormt echter geen definitieve eindbeslissing over de rechtmatigheid van de FFAR. De procedure is nog lopende, maar een voorlopige schorsing vormt een ernstig signaal naar FIFA.

2. Legal action against the FIFA Football Agent Regulations

 

The FIFA Football Agent Regulations, approved on 16 December 2022, came partially into force on 9 January 2023. The new regulations are controversial and severely restrict the freedom of the football agent profession. Several initiatives have already been taken to challenge these rules in national courts. Mainly within Europe, the legality and proportionality of the regulations have been criticised.

 

Although many footballagents have already taking the new FIFA exam on 19 April 2023, it now appears that the definitive entry into force of the new regulations on 1 October 2023 is not a foregone conclusion. This is because the Dortmund District Court in Germany has suspended the application of the FFAR on German territory. This means that, as long as the suspension runs, the new rules – including the cap on commission fees – will not apply in Germany. A football agent active in Germany, will therefore not be obliged to cap his commission fee at 3 or 5% from 1 October 2023.

 

The precedent in Germany can be used and may convince judges of other countries to make the same decision. This, in turn, could have the effect of delaying or avoiding the entry into force of the regulations as they stand at present.

 

However, such suspension does not constitute a final final decision on the legality of the FFAR. The proceedings are ongoing, but a provisional suspension constitutes a serious signal to FIFA.
