Racing car on a circuit during a race

Motorsport lawyer in Belgium

Motorsport runs on regulations and on very short deadlines

In motorsport almost everything is fixed in a regulation. Who may start, which parts are allowed, how a protest works and who carries the damage after a crash: it is written in the sporting and technical regulations of the organiser and of the federation. Whoever misses the procedure loses the case before anyone looks at the merits. We assist drivers, riders, teams, circuits, organisers and sponsors, from the licence application to the appeal against a penalty.

The RACB is the Belgian ASN under the FIA and issues the licences for car racing. For motorcycle racing the FMB and the FIM are competent. Decisions of the stewards follow the International Sporting Code, with a protest to the race direction and then an appeal before the national body or before the FIA International Court of Appeal. Everest Sports Law follows both the Belgian and the international route.

What we do in motorsport

These are the files that reach our desk most often.

Licences and entry to an event

A competition licence, a medical examination and an entry hang together. We prepare the application before the RACB or the FMB, and we run the appeal against a refusal, a suspension or a withdrawal of the licence.

Penalties from the stewards

A time penalty, an exclusion or a removal from the results comes from the stewards of the meeting. We draft the protest, collect the telemetry, the footage and the witness statements, and we lodge the appeal within the deadline set by the regulations.

Scrutineering and technical protests

A dispute about a part, about a fuel sample or about a measurement outside tolerance is settled by the technical delegates. We prepare the protest or the defence, and we watch the sealing of the parts, the counter expertise and the evidence.

Liability of the circuit and the organiser

After an accident involving a driver, a marshal or a spectator, the question turns to the safety of the track, the homologation, the signalling and the value of the waiver in the entry form. We defend organisers, circuits and injured parties.

Team, driver and sponsorship contracts

We draft and negotiate contracts between driver, team and sponsor: the budget, the seat, the test days, the bonuses, the use of image and logo, and the consequences when a season stops early.

Permits, noise and environment

A circuit or a road event needs an environmental permit, a municipal authorisation and a noise limit. We prepare the application, defend the operator against complaints from neighbours and run the appeal against a refusal or a restriction.

How a motorsport lawyer in Belgium runs your file

Who decides

The stewards decide during the event. The national appeal body of the RACB or of the FMB follows, and in international matters the FIA International Court of Appeal or the competent FIM body. A dispute about damage or about a contract goes to the ordinary court.

The deadlines

Here the deadlines are counted in minutes and hours. A protest against the results must usually be lodged within thirty minutes of their publication. The intention to appeal often follows within the hour, and the appeal itself within a few days. Check the applicable regulations before you leave the paddock.

What you do first

Keep the regulations, the results, the report of the stewards, the data from the car or the bike and the footage. Ask for a copy of the technical report at once. Call us from the circuit, because a missed deadline cannot be repaired.
