Selection, discipline and contracts in swimming
Swimming in Belgium is organised through two community federations, Zwemfed on the Flemish side and the FFBN on the French-speaking side, with the Royal Belgian Swimming Federation as the national body. A swimmer who competes at a high level is therefore bound by several sets of rules at the same time: those of the club, those of the federation and those of World Aquatics and European Aquatics. Each layer has its own selection criteria, its own disciplinary rules and its own deadlines.
We advise swimmers, clubs, coaches, sponsors and event organisers within that framework. The work ranges from a contested selection for a European Championship, a World Championship or the Olympic Games, through a doping file or a whereabouts dispute, to a contract with a club, a sponsor or a pool operator. We also handle international files: proceedings before international federations, arbitration before the CAS in Lausanne and cross-border contracts.

Selection and qualifying times
We test selection criteria and qualifying times for a European Championship, a World Championship or the Olympic Games against the rules of the federation. If a selection is wrongly withheld, we build the file and run the internal appeal or apply for interim relief.
Elite sport status and funding
An elite sport status, a grant or a subsidy depends on criteria set by the public authorities and the federation. We review those criteria, challenge a refusal or a withdrawal, and support the discussions with the federation and the sports administration.
Doping and whereabouts
A missed test, an error in a whereabouts filing or an adverse analytical finding leads to disciplinary proceedings with serious consequences. We defend the swimmer, watch every deadline and check whether the sample collection, the analysis and the procedure were correct.
Discipline and coach conduct
Complaints about the conduct of a coach, a swimmer or a board member go before a disciplinary body with its own rules. We assist both the person concerned and the club or federation, and make sure the rights of defence are respected.
Contracts and sponsorship
We draft and negotiate contracts between swimmers, clubs, coaches and sponsors. Attention goes to image rights, exclusivity, performance bonuses and the question of how far federation rules limit the individual sponsorship of a swimmer during championships and training camps.
Pools and liability
An accident in the pool raises questions about supervision, lifeguard cover, safety standards and insurance. We advise clubs, operators and organisers on their liability, on user agreements for swimming pools and on the handling of a damage claim.
How a swimming lawyer in Belgium runs your file
Who decides
A body of the club or of the federation decides first. The file can then go to arbitration or to court, often in summary proceedings when a competition is close. Decisions of World Aquatics end up before the CAS in Lausanne.
Deadlines
The deadlines are short. An appeal against a selection or against a disciplinary decision is often counted in days, and it keeps running during a training camp or a holiday. A late appeal is dismissed without any review of the merits.
