The law around golf, in Belgium and abroad

A golfer usually works without an employer. There is no employment contract, but there is a management or player agreement, sponsorship deals, the entry conditions of a tour and the rulebook of a federation. In Belgium, membership and competition run through Golf Vlaanderen, the AFGolf and the Royal Belgian Golf Federation. A problem therefore rarely involves a single counterparty, and rarely ends before a single court.

We handle international files as well. A Belgian player who enters a foreign tour, a contract under English law, prize money taxed in several countries, or a dispute that goes to an arbitral body such as the CAS/TAS in Lausanne: each of these needs a lawyer who reads the rules as they are written. Management and player agreements

We negotiate and review contracts with a manager or an agent: duration, commission, exclusivity, termination, and what happens to running sponsorship income after the contract ends. We also act when the parties dispute commission that was paid or withheld.

Sponsorship and image rights

Clothing, clubs, balls and equipment: every sponsor buys visibility and rights in your name and image. We set out what the sponsor may use, for which markets and for how long, and what applies after an injury or a poor season.

Prize money and cross-border tax

Tournaments often withhold tax on prize money and appearance fees in the country of play. We work with your accountant on the contractual side: who carries which charge, whether amounts are gross or net, and which documents you need.

Membership, suspension and expulsion

A club may suspend or expel a member, but it must respect its own articles of association, its internal rules and the member’s right to be heard. We run that procedure inside the club and, where it remains necessary, before the court.

Golf courses, operation and permits

Building and running a course raises questions of environmental permits, water management, use agreements with the landowner, and the relation between the non-profit association and the operating company. We guide applications, objections and appeals.

Liability and accidents on the course

A ball that hits someone, a fall on an unsafe path, damage caused by a buggy: we assess the liability of the player, of the club and of the insurer, and we take the discussion to the insurance company or to court.

The body that decides is named in the articles of the club or the federation: a disciplinary committee, an appeal body, sometimes arbitration. We read those texts first, because they also govern whether and when you can go to court.

Deadlines are short

In disciplinary and selection files, appeal deadlines often run in days rather than months, and they start when the decision is notified. Contact us as soon as you receive the decision, not after the deadline has passed.
